Notice of Beijing Municipal Commission of Housing and Urban-Rural Development on Relevant Issues Concerning the Application, Examination and Issuance of Market Rental Subsidies

In order to standardize the management of the application, review and distribution of market rental subsidies in our city, according to the Guiding Opinions of the Ministry of Housing and Urban-Rural Development on Accelerating the Cultivation and Development of the Housing Rental Market (J.F. [2015] No.4), combined with the actual situation of this city, the relevant issues are hereby notified as follows:
I. Qualification application and review
(1) Application
Family income, housing, assets and other urban registered families that meet the requirements for applying for market rental subsidies in this Municipality may receive the Examination Form of Beijing Market Rental Subsidies from the housing security management department of the neighborhood offices (township people’s governments) where they are registered, fill in relevant contents as required, and submit it to the neighborhood offices (towns and villages) where they are registered, with the relevant supporting materials of family population, housing, income and assets. If the waiting period of affordable housing or price-limited commodity housing for the record meets the application conditions of market rental subsidies, they can apply for solving the difficulties during the transition period through market rental subsidies.
(2) Audit
The review of family population, income, housing, assets, etc. shall be carried out in accordance with the current policies on affordable housing in this Municipality. The audit procedure is as follows:
1. Street (township) preliminary examination: The housing security management department of the street office (township people’s government) shall make a decision on whether to accept or not within 2 working days after receiving the materials submitted by the applicant, and issue a written certificate to the applicant. If the application materials are incomplete or do not conform to the statutory form, they shall be informed together.
Street offices (Township People’s Government) housing security management department decided to accept, should be within 10 working days of accepting the application, complete the preliminary work of applying for family application materials. In the first instance, with the cooperation of civil affairs, public security, taxation, social security, real estate registration and other departments, the information of marriage, household registration, population, housing, income and other conditions of families subsidized by market rental should be compared and verified. Information comparison and verification time is not included in the audit time limit.
Audited eligible, by the neighborhood offices (Township People’s Government) housing security management department will apply for family population, income, housing, assets and other information in the applicant’s domicile and residence community publicity, publicity period of not less than 5 days. If there is no objection or objection is not established at the expiration of the publicity period, the housing security management department of the subdistrict office (Township People’s Government) shall put forward the preliminary examination opinions, and report the preliminary examination opinions and related materials to the district and county housing security management departments within 2 working days.
After the preliminary examination does not meet the conditions, the street office (Township People’s Government) housing security management department will promptly inform the applicant family in writing of the unsuccessful results, reasons and review rights.
If the applicant family has any objection to the results of the preliminary examination, it shall apply to the district and county housing security management department where the household registration is located within 30 working days after receiving the notification, and submit relevant certification materials. If the application for review is filed within the time limit, it will not be accepted. The district and county housing security management department shall complete the review within 15 working days, and inform the applicant family of the review results in writing. If the objection is established after review, the housing security management department of the street office (Township People’s Government) will resume the follow-up audit work. The review time is not included in the audit time limit.
2. District and County Review: The district and county housing security management department shall complete the review within 10 working days from the date of receiving the application materials submitted by the housing security management department of the sub-district office (township people’s government). If it meets the requirements, the audit results shall be determined. The district and county housing security management department shall publicize the population, income, housing and assets of eligible families on the website of the district and county government for a period of not less than 5 days. Review the families that meet the conditions of market rental subsidies and publicize them without objection. The district and county housing security management departments formulate the Notice of Qualification for Market Rental Subsidies in Beijing, which will be distributed to eligible families by the housing security management departments of sub-district offices (township people’s governments).
If there is any objection to the results of publicity or review, the applicant family may apply for it in accordance with the relevant provisions of the preliminary objection review of the housing security management department of the street office (Township People’s Government).

The district and county housing security management departments shall, in accordance with the requirements, scan and upload all the paper archives of the family to the working system of the housing security comprehensive information management service platform (hereinafter referred to as the "system").
Second, the distribution management
(A) market rental
Families who have obtained the market rental subsidy qualification should rent their own houses in the market within 6 months. If they fail to implement the rental housing and go through the formalities for receiving the market rental subsidy for more than 6 months, they will be deemed to have voluntarily given up the market rental subsidy qualification, and their market rental subsidy qualification will be automatically terminated.
Market rental subsidies for family rental housing must meet the requirements of relevant laws and regulations on residential housing rental management, and have valid proof of housing ownership or proof of legal source of housing and other materials. If renting a bungalow, the lessor shall also provide the house safety appraisal certificate. Market rental subsidy families should sign housing lease contracts with housing lessors.
(2) Handling the procedures for receiving subsidies.
1. apply for it. From the date of the lease term of the housing lease contract, the applicant for market rental subsidy and the lessor of the house shall go through the formalities for receiving the market rental subsidy together with the housing security management department of the neighborhood office (township people’s government) where the household registration is applied. When going through the formalities, the applicant shall provide the ID card, Notice of Qualification for Rental Subsidies in Beijing Market, the housing lease contract, the bank card issued by the applicant himself in the subsidy issuing bank and other materials and copies; The lessor of the house shall provide ID card, proof of ownership of the house or proof of legal source of the house (including house sales contract and invoice, demolition compensation agreement, etc.) and other materials and copies.
2. Review materials and approve subsidies. Neighborhood offices (Township People’s Government) housing security management department verification materials. If the materials are complete and conform to the legal form, the housing security management department of the sub-district office (Township People’s Government) shall keep a copy, input the relevant information into the system, print the Confirmation Sheet of Beijing Market Rental Subsidy Information, submit it to the district and county housing security management department after the applicant has checked it and signed it for confirmation, and report the relevant materials to the district and county housing security management department for review within 2 working days. If the materials are incomplete or do not meet the statutory form, the housing security management department of the sub-district office (Township People’s Government) shall inform the applicant of all the contents that need to be supplemented.
The district and county housing security management department shall review the relevant materials within 5 working days. In line with the conditions for receiving market rental subsidies, the district and county housing security management departments shall verify the actual amount of subsidies for families with market rental subsidies through the system. If the rent of the market rental subsidy family rental housing exceeds the rental subsidy standard of the household, the rental subsidy shall be determined according to the rental subsidy standard, and the excess shall be borne by itself; If it is lower than the rental subsidy standard, the rental subsidy shall be determined according to the rental amount of the rental housing. The district/county housing security management department shall formulate the Notice on Payment of Market Rental Subsidies in Beijing, which shall be issued to the applicant by the housing security management department of the subdistrict office (township people’s government). Do not meet the conditions for receiving market rental subsidies, the district and county housing security management departments to develop the "Beijing market rental subsidies to terminate the notification form", by the street office (Township People’s government) housing security management departments on behalf of the applicant.
(3) Distribution
If a family with market rental subsidy goes through the formalities of receiving market rental subsidy in the current month, the subsidy will be calculated and distributed from the next month. The district/county housing security management department generates the detailed distribution of market rental subsidies through the system, and distributes the market rental subsidies to the applicant’s bank account through the bank before the 20th of each month.
(4) publicity
The housing security management departments of all districts and counties shall publicize the situation of enjoying the security of families with market rental subsidies last month on the websites of district and county governments before the 20th of each month, and accept social supervision.
The publicity content includes the name of the applicant for market rental subsidy, the guaranteed population, the monthly family subsidy amount, the name of the district, county and street (township) where the household registration is located, and the address of the rented house. The publicity period is from the date of receiving the market rental subsidy to the date of stopping issuing the market rental subsidy.
Third, dynamic management
(A) daily dynamic management
1. The housing security management departments of all districts and counties and the housing security management departments of subdistrict offices (township people’s governments) find that families with market rental subsidies no longer meet the conditions of market rental subsidies by accepting their own declarations, reports from the masses, media supervision, information comparison and inspections, etc., and shall cancel their qualifications for market rental subsidies and stop issuing market rental subsidies from the next month. For families that need to adjust subsidies, subsidies will be paid according to the adjusted amount of subsidies from the month after the change of subsidy eligibility.
2. If the housing lease contract signed by the family with market rental subsidies expires, the district and county housing security management department shall stop issuing market rental subsidies from the next month after the lease contract expires. If the house lease contract is renewed, the house lease contract shall be resubmitted according to the provisions of this notice one month before the lease contract expires and the relevant formalities shall be handled, and the district and county housing security management departments shall continue to issue it according to the approved amount of market rental subsidies.
In the period of validity of the housing lease contract, if the market rental subsidy family and the housing lessor change or terminate the lease contract in advance, the market rental subsidy family should report to the housing security management department of the subdistrict office (township people’s government) applying for the market rental subsidy within 10 days after the change or termination of the lease contract. For families who need to adjust the market rental subsidy due to the change of the lease contract, the district and county housing security management department shall issue subsidies according to the adjusted amount of subsidies from the month after the approval of subsidies. For families with market rental subsidies who terminate the lease contract in advance, the district and county housing security management departments should stop issuing market rental subsidies from the month after the lease contract is terminated. If the family fails to declare the market rental subsidy, which leads to more subsidies, it shall be regarded as defrauding the market rental subsidy, and it shall be handled according to the relevant provisions of this notice.
After the expiration or early termination of the housing lease contract, the subsidized families in the market should re-implement the rental housing and go through the relevant formalities according to the provisions of this notice.
(2) Annual dynamic management
1. Families with market rental subsidies should report changes in family population, income, housing, assets and rental to the housing security management department of the subdistrict office (township people’s government) applying for market rental subsidies one month in advance when they enjoy the market rental subsidies for every 12 months; If the family situation has not changed, it must also be reported to the housing security management department of the street office (township people’s government) that applies for the market rental subsidy.
2. For subsidized families who declare their family status in accordance with regulations, The housing security management departments of districts and counties and sub-district offices (township people’s governments) refer to the qualification review management procedures stipulated in the Notice on Further Strengthening the Management of Qualification Examination for Low-rent Housing, Affordable Housing and Price-limited Commercial Housing (J.J.F. [2010] No.206) and the Notice on Further Strengthening the Management of Qualification Examination for Affordable Housing (J.J.J. Zi [2017])
3. According to the qualification review decision, the district/county housing security management department will deal with the subsidy distribution of the market rental subsidy families respectively:
For families with market rental subsidies that maintain the original subsidy qualification, the district and county housing security management departments still issue subsidies according to the original subsidy amount; For families with subsidized housing in the market who change their eligibility for subsidies, the district and county housing security management departments will issue subsidies according to the adjusted amount of subsidies from the month after the qualification change. For families who terminate or cancel the qualification of market rental subsidies, the district and county housing security management departments will stop issuing subsidies from the month after the qualification is terminated or cancelled.
If a family with market rental subsidy has not declared its family population, income, housing, assets and rental when it enjoys the market rental subsidy for 12 months, it will be regarded as voluntarily giving up its qualification for market rental subsidy, and its qualification for market rental subsidy will be automatically terminated. The district and county housing security management departments will stop issuing subsidies from the month after it enjoys the market rental subsidy for 12 months.
Fourth, supervision and management
(1) For applicants who fail to truthfully declare their family population, income, housing, assets, etc. and falsify relevant certificates to defraud the market rental subsidy, the district/county housing security management department shall cancel the qualification of the market rental subsidy, and if the market rental subsidy has been defrauded, the district/county housing security management department shall order it to be returned, which shall be publicized through the media and included in the credit file. Applicants shall not apply for the housing security qualification and self-occupied commercial housing again within five years. If the case constitutes a crime, it shall be handed over to judicial organs for handling. State organs, institutions, state-owned enterprises and other staff members who provide false certificates to defraud the market rental subsidies shall be handed over to the relevant discipline inspection and supervision organs for handling.
(II) The district/county housing security management department shall organize relevant departments or entrust a third-party agency to take spot checks and centralized inspections to check the situation of family rental housing subsidized by the market, and prevent fraudulent rental subsidies such as forging contracts, fabricating false leases, subletting for profit, and undeclared contract termination. To defraud the market rental subsidies, in accordance with the provisions of the preceding paragraph. At the same time, organize relevant departments to check the fraudulent behavior of market rental subsidies reported by the masses and exposed by the media, and disclose the results to the public.
(three) the municipal housing security management department shall guide, supervise and regularly inspect the rental subsidies in the district and county markets. If it is found that it violates the relevant regulations or does not follow the procedures, it shall be ordered to make rectification within a time limit, and the rectification situation shall be inspected. Those who have caused adverse effects shall be submitted to the discipline inspection and supervision organs for investigation and handling.
Five, the market rental subsidy policy and other policies of convergence
(A) the convergence of market rental subsidies and low-cost housing rental subsidies
After the implementation of this notice, the city will no longer accept applications for low-rent housing rental subsidies. Families who meet the prescribed conditions and rent housing in the market will be guaranteed by applying for market rental subsidies. For low-rent housing rental subsidy families, the housing security management departments of all districts and counties still issue subsidies in accordance with the relevant provisions of the original low-rent housing policy. Low-rent housing rental subsidy families have obtained the market rental subsidy qualification and gone through the subsidy collection procedures. The district and county housing security management departments should cancel their low-rent housing security qualification, stop issuing low-rent housing rental subsidies the following month, and issue subsidies according to the market rental subsidy standards.
(B) the convergence of market rental subsidies and public rental housing rental subsidies
Protect families from enjoying market rental subsidies and public rental housing security at the same time. During the waiting period for families to file public rental housing, those who meet the application conditions for market rental subsidies may apply for protection through market rental subsidies.
Enjoy the market rental subsidies for families to obtain the qualification of public rental housing rent subsidies, since the beginning of the public rental housing lease period next month, the district and county housing security management departments to stop issuing market rental subsidies, in accordance with the provisions of the standard payment of public rental housing rent subsidies; Enjoy the public rental housing rent subsidies for families to obtain the qualification of market rental subsidies, settle the public rental housing related expenses and terminate the public rental housing contract, go through the formalities for receiving market rental subsidies, and the district and county housing security management departments will stop issuing public rental housing rent subsidies the next month, and pay subsidies according to the market rental subsidy standards. After ensuring that families realize the mutual conversion between public rental housing rent subsidies and market rental subsidies, they may not apply for conversion again within one year.
Six, this notice shall come into force as of November 16, 2015.
