Implementation Opinions of the General Office of Yunnan Provincial People’s Government on Deepening the Reform of Management System in Electronic and Electrical Industry

State and municipal people’s governments, provincial committees, offices, departments and bureaus:

In order to implement the spirit of Opinions of the General Office of the State Council on Deepening the Reform of the Management System of Electronic and Electrical Appliances Industry (No.31 [2022] of Guo Ban Fa), improve the efficiency of government supervision, optimize the management system of electronic and electrical appliances industry, better stimulate the vitality of market players, and promote industrial transformation and upgrading and technological innovation, with the consent of the provincial people’s government, we put forward the following opinions:

I. Guiding ideology

Adhere to the guidance of the Supreme Leader’s Socialism with Chinese characteristics Thought in the new era, fully implement the spirit of the 20th Party Congress, thoroughly implement the spirit of the important speech of the Supreme Leader’s General Secretary on his inspection of Yunnan, conscientiously implement the decision-making arrangements of the CPC Central Committee and the State Council on deepening the "streamline administration, delegate power, strengthen regulation and improve services" reform and optimizing the business environment, fully, accurately and comprehensively implement the new development concept, actively serve and integrate into the new development pattern, and optimize the production access and circulation management of the electronic and electrical industry throughout the process. Strengthen the supervision of the whole chain in all fields before and after the event, greatly reduce the institutional transaction costs, stimulate the innovation power and development vitality of enterprises, promote the research and development of technical products and fair competition in the market, earnestly safeguard the safety and stability of the supply chain of electronic and electrical related industrial chains, and accelerate the high-quality development of the electronic and electrical industry.

Two, the full implementation of the national electronic and electrical products access management system.

(1) Strictly implement the national compulsory certification management system for electronic and electrical products. Strengthen the supervision of certified products in the compulsory product certification catalogue (see Annex 1), and arrange the supervision and spot check of compulsory certified products every year in combination with the "double random and one open" supervision and spot check plan to ensure the continuous improvement of the quality of certified products.(Responsible by the Provincial Market Supervision Bureau)

(2) Improve the network access licensing system for telecommunication equipment. Support enterprises to apply for network access license for qualified telecom equipment. Satellite Internet equipment and functional virtualization equipment will be included in the scope of supervision and inspection of network access permission of telecommunication equipment in Yunnan Province, and 11 kinds of telecommunication equipment (see Annex 2) with less connection with telecommunication security and mature technology will not be inspected for network access permission. Implement the provisions of the 2-year validity period of the trial approval for entering the network. We will implement the electronization of network access license marks, and no longer require network access license numbers to be marked on the packaging, built-in information and advertisements of telecom equipment products. Strengthen the post-event supervision of telecom equipment network access license, and seriously investigate and deal with the behavior of sales or use before obtaining network access license. The family management of telecom equipment products shall be implemented. For products that have obtained the network access license, if the licensed enterprise adds or changes the entrusted production enterprise, or changes the technology and appearance of the main functions and core components, the network access license will not be re-applied.(Responsible for the Provincial Communications Administration)Unify the requirements of network access license and compulsory certification electromagnetic compatibility (EMC) testing for telecommunications equipment. When enterprises apply for license and certification, they only need to conduct one test, and the test reports are mutually recognized.(Provincial Market Supervision Bureau and Provincial Communications Administration are responsible for the division of responsibilities)

(three) the implementation of radio transmitting equipment model approval system. Strengthen the publicity, implementation and interpretation of policies related to the type approval of radio transmitting equipment, and guide enterprises to independently compile approval codes in strict accordance with the coding rules formulated and promulgated by the Ministry of Industry and Information Technology. Seriously investigate and deal with the sale or use of radio transmitting equipment before obtaining model approval.(Responsible by the Provincial Department of Industry and Information Technology)

(four) to promote the self-inspection and self-certification of electronic and electrical products. Conduct self-inspection and self-certification pilot projects in telecommunications equipment, radio transmitting equipment, information technology equipment and household appliances manufacturers with complete conditions and good quality management level and credit. When a pilot enterprise applies for network access license of telecommunication equipment, model approval of radio transmitting equipment and compulsory certification, it may use its own test report instead of the third-party test report, except for special testing items such as network security. The development of self-inspection and self-certification shall be publicized to the public and accepted by the society and industry. According to the pilot effect, the self-inspection and self-certification system for electronic and electrical products will be gradually popularized.(The Provincial Department of Industry and Information Technology, the Provincial Market Supervision Bureau and the Provincial Communications Administration are responsible for the division of responsibilities)

(five) the implementation of radio and television equipment network identification system. In strict accordance with the relevant regulations of the State Administration of Radio, Film and Television on the identification of radio and television equipment and the list of dynamically adjusted varieties, we will do a good job in the management of network identification. The management of network identification is no longer implemented for standard-definition equipment. Fully implement the electronic management of network access identification, and replace paper certificates with electronic certificates.(Responsible by the Provincial Radio and Television Bureau)

Three, the integration of green product evaluation and certification system

(six) standardize the product evaluation and certification system. Cancel the selection of energy efficiency "leader" products and the evaluation system of energy efficiency star products. Continue to standardize the promotion and application of energy efficiency labels, and encourage enterprises to continuously improve product energy efficiency. For products that have been certified as green products or have passed the certification of energy-saving and low-carbon products, they are entitled to preferential procurement or compulsory procurement policies in accordance with regulations in government procurement. Carry out green smart home appliances to the countryside to promote the consumption of household electronic appliances with green product identification.(Provincial Development and Reform Commission, Provincial Department of Industry and Information Technology, Provincial Department of Finance, Provincial Department of Ecology and Environment, Provincial Department of Water Resources, Provincial Department of Commerce, Provincial Market Supervision Bureau and Provincial Energy Bureau are responsible for the division of responsibilities)Except as explicitly stipulated by laws, administrative regulations and the State Council decisions, all localities and departments shall not set up and implement identification, certification, appraisal, evaluation, selection and labeling systems involving energy conservation, resource conservation, environmental protection, low carbon and green products outside the certification and labeling system for green products.(The people’s governments at the state and municipal levels and the relevant departments at the provincial level shall be responsible for the division of responsibilities)

Four, establish and improve the system to support the high-quality development of basic electronics industry.

(seven) increase the basic electronics industry R&D and innovation support. Comprehensively sort out the key core technology requirements in the development of basic electronic industries (electronic materials, electronic components, electronic special equipment, electronic measuring instruments and other manufacturing industries), and actively plan the layout of key projects. Promote relevant enterprises in the field of basic electronics industry to form an innovation consortium, unite upstream and downstream enterprises, universities and research institutes, concentrate superior resources, and focus on weak or missing links to carry out key core technology research. Guide superior enterprises to integrate resources and actively strive for the support of relevant state ministries and commissions in the planning and policies of major projects. Coordinate relevant provincial policy resources, increase support for the upgrading of basic electronics industry and key technological breakthroughs, and accelerate the layout of innovation platforms such as manufacturing innovation centers, technological innovation centers, engineering research centers, and enterprise technology centers. Implement the mechanism of "unveiling the list", encourage scientific research units and basic electronic enterprises in relevant industries to undertake major national and provincial R&D tasks, and focus on supporting the development of cutting-edge technologies and products with high technical threshold, many application scenarios and broad market prospects.(Provincial Development and Reform Commission, Provincial Department of Industry and Information Technology and Provincial Department of Science and Technology are responsible for the division of responsibilities)

(eight) to promote the application system of basic electronic products. Encourage basic electronic products production enterprises to participate in the scientific research and production of weapons and equipment, and need to apply for the record of scientific research and production of weapons and equipment, and apply to the Provincial Defense Science and Technology Bureau in accordance with relevant state regulations.(The Provincial Department of Industry and Information Technology and the Provincial Bureau of National Defense Science and Technology are responsible for the division of responsibilities)

(9) Increase financial support. Give play to the guiding role of special financial funds such as provincial-level special funds for high-quality development of manufacturing industry and special funds for the development of small and medium-sized enterprises, support qualified basic electronic industry projects, encourage relevant investment funds and social capital investment, increase support for enterprise innovation and research and development, technological transformation, intelligent manufacturing, etc., focus on cultivating high-quality enterprises in the industry, and support the development of "chain owners" enterprises in the industrial chain, single champion enterprises in manufacturing industry and "specialized and innovative" small and medium-sized enterprises.(The Provincial Development and Reform Commission, the Provincial Department of Industry and Information Technology and the Provincial Department of Finance are responsible for the division of responsibilities)Encourage all kinds of financial institutions to innovate financial products and services, strengthen credit policy guidance, and increase financial support for the basic electronics industry. Focus on market players such as high-tech enterprises, "specialized and innovative" small and medium-sized enterprises, and high-tech small and medium-sized enterprises, and increase credit loans and first loans. Increase the medium and long-term financial support for the electronic and electrical industry in terms of equipment renewal, technological transformation and green transformation and development. Expand the coverage of export credit insurance, increase the intensity of export credit, and help electronic and electrical enterprises to stabilize orders and expand the market. (ten) increase the basic electronics industry R&D and manufacturing land support. Support basic electronic enterprises to develop and manufacture new basic electronic products. Under the premise of conforming to the national spatial planning, it is allowed to increase supporting R&D, design, testing and pilot facilities on the construction land of industrial projects by adjusting the land structure. If the construction area does not exceed 15% of the total construction area, the land can continue to be used according to the original purpose.(Responsible by the Provincial Department of Natural Resources)

Five, optimize the circulation management system of electronic and electrical industry.

(eleven) improve the import and export management system of electronic and electrical industry. Encourage enterprises in the electronic and electrical industry to carry out digital upgrading, optimize and adjust the categories of export products in a timely manner with the help of big data analysis, continuously expand the overseas marketing network, and expand the export scale of cross-border e-commerce. Strictly implement the national export tax rebate, export credit insurance and other foreign trade policies, ensure that the export tax rebate is settled within the prescribed time limit, and help the development of electronic and electrical foreign trade export enterprises. We will implement preferential tax policies for cross-border e-commerce, expand the supply of export credit, and support the development of cross-border e-commerce for enterprises in the electronic and electrical industries.(The Provincial Department of Finance, the Provincial Department of Commerce, Kunming Customs, the Provincial Taxation Bureau, Kunming Central Branch of the People’s Bank of China, Yunnan Banking Insurance Regulatory Bureau, Yunnan Branch of the Export-Import Bank, and Yunnan Branch of the Export Credit Insurance Company are responsible for the division of responsibilities.)Actively publicize and implement relevant customs policies, and do a good job in ensuring import and export customs clearance services for enterprises in the electronic and electrical industry; Strengthen the supervision and risk monitoring of import and export quality and safety inspection of electronic and electrical products in our province, and timely follow up and implement the catalogue of import and export commodities that must be inspected. Vigorously promote the reform of various customs clearance services, steadily promote customs clearance modes such as "two-step declaration", "declare in advance" and "two-step access", improve customs clearance efficiency, fully release reform dividends, and enhance the sense of acquisition of import and export enterprises.(Provincial Market Supervision Bureau and Kunming Customs are responsible for the division of responsibilities)

(twelve) to strengthen the supervision of waste electronic and electrical products recycling industry. Strictly carry out the audit of dismantling and disposal of waste electronic and electrical products, and implement the subsidy policy and preferential tax policy of the national waste electronic and electrical products disposal fund. Give full play to the incentive and guiding role of the current preferential tax policies for comprehensive utilization of resources, and reasonably reduce the burden on enterprises dealing with waste electronic and electrical products.(The Provincial Department of Finance and the Provincial Taxation Bureau are responsible for the division of responsibilities)Efforts will be made to optimize the layout of the recycling network of waste electronic and electrical products, and continuously improve the level of resource utilization and harmless treatment of waste electronic and electrical products. Support the construction of after-sales maintenance and recycling service outlets for household appliances around the country. Support relevant enterprises to build recycling outlets and transit warehouses, promote the construction of online and offline recycling networks for waste electronic and electrical products, and guide waste electronic and electrical products to flow into standardized dismantling enterprises. Encourage the popularization and application of new technologies, new processes and new equipment, promote intelligent and refined disassembly, and promote high-value utilization. Strengthen the supervision of recycling and disposal of waste electronic and electrical products, take illegal dismantling and disposal of waste electronic and electrical products as the focus of supervision, and increase law enforcement punishment. Supervise and urge enterprises to do a good job in pollution prevention and control during the whole process of dismantling waste electronic and electrical products.(The Provincial Development and Reform Commission, the Provincial Department of Industry and Information Technology, the Provincial Public Security Department, the Provincial Department of Ecology and Environment and the Provincial Department of Commerce are responsible for the division of responsibilities)

(thirteen) standardize the management of electronic and electrical industry business evaluation activities. Strictly regulate the management of commercial evaluation activities in the electronic and electrical industry, and basic telecom operators shall not organize commercial evaluation of telecom equipment products. Clean up and rectify the acts that exist in the business evaluation activities, such as using the name of administrative organs and institutions, setting up business evaluation names indiscriminately, issuing business evaluation certificates indiscriminately, "spending money to buy rankings", eating cards and so on, which undermine the fair competition order in the market.(The Provincial Department of Industry and Information Technology, the Provincial Market Supervision Bureau and the Provincial Communications Administration are responsible for the division of responsibilities)

Six, the implementation of the whole chain and all areas of supervision before and after the event.

(fourteen) strictly implement the requirements of the combination of release and management. Strengthen supervision after the event, perform supervision duties, closely supervise coordination, and improve supervision efficiency. For products that are no longer subject to administrative licensing or compulsory certification management, the regulatory responsibility shall be tightened, the proportion of supervision and spot checks shall be determined according to the risk status, and illegal acts shall be investigated and dealt with according to law. For products that continue to be subject to administrative licensing or compulsory certification management, according to the principle of "who examines and approves, who supervises, who certifies and who supervises", the unlicensed production behavior or the production behavior that the product quality does not meet the requirements after being certified shall be severely investigated and punished according to law. Improve the joint working mechanism of information collection on defects of electronic and electrical products, strengthen the collection and analysis of information on defects of electronic and electrical products, strictly implement the recall system of defective electronic and electrical products, urge producers to fulfill the main responsibility of recall and actively fulfill the recall obligations.(Provincial Department of Industry and Information Technology, Provincial Public Security Department, Provincial Market Supervision Bureau, Provincial Bureau of Radio, Film and Television and other departments, and the people’s governments of the prefectures and cities are responsible for the division of responsibilities)

(fifteen) improve the supervision and management rules of electronic and electrical products. We will fully implement cross-departmental and cross-level "double random and open" collaborative joint supervision, and make a spot check plan according to the annual overall plan to reduce repeated spot checks. Improve the credit supervision system, classify the risk level of electronic and electrical enterprises, and link the proportion and frequency of supervision and spot checks with the credit status and risk level of enterprises. For products that are directly related to the safety of people’s lives and property and public safety, as well as products with high potential risks and high social risks, we will implement key supervision, find and dispose of major risks in time, and keep the bottom line of safety. It is necessary to strengthen overall coordination and supervise the implementation, coordinate and solve the key and difficult problems in the implementation of this opinion in a timely manner, and report major situations to the provincial people’s government in a timely manner.
